Welcome to Hasalynx Press (“we,” “us,” “Publisher”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile apps, digital library, forums and related features (collectively, the “Service”). By browsing, registering, subscribing, submitting content or otherwise using the Service, you agree to these Terms in full. If you do not agree, please stop using the Service immediately.

1. Definitions
1.1 Service Hasalynx Press’s online platforms, including hasalynxpress.com, digital content delivery systems and related features.
1.2 User / Subscriber Any individual or legal entity that accesses or uses the Service.
1.3 Subscription A plan acquired or purchased under Section 6 that grants access to the digital library or its portions as specified by the subscription plan.

1.4 Content in the Online Catalogue

All materials available through the Online Catalogue — including Hasalynx Pearls, Classical Gems, translations, book descriptions, tables of content, and book covers — are part of the Service.

Hasalynx Pearls are original literary works developed entirely in-house by Hasalynx Press. They are created through proprietary creative processes under the sole direction of the business owner. These works are published under pen names, all of which are owned exclusively by Hasalynx Press and do not represent independent authors. All intellectual property rights to Hasalynx Pearls are solely and exclusively owned by Hasalynx Press. No third-party author contracts exist in relation to these works.

Classical Gems are public domain titles by authors who passed away before 1925, whose copyrights have expired worldwide. While the core texts are in the public domain, any original enhancements, formatting, annotations, or translations developed by Hasalynx Press are the intellectual property of Hasalynx Press and may not be copied or redistributed.

Translations are produced by Hasalynx Press to make the catalogue more accessible. Translation methods may vary. All translations are owned exclusively by Hasalynx Press. The English-language catalogue remains the editorial basis of your subscription.

Book covers and visual assets are created for branding and presentation purposes and may be developed using digital design tools. No ownership is claimed over any third-party elements used under license.
1.5 Reviews and User Content
Users may submit reviews, comments, or other content under their chosen nickname. By submitting content, users agree to our Review Guidelines and grant Hasalynx Press a license to display their contributions. Legal names are not shown.​

2. Acceptance & Scope
2.1 Entire Agreement    These Terms, together with our Privacy Policy, Refund Policy and Review Guidelines form the complete agreement between you and Publisher regarding the Service. They supersede all prior agreements.
2.2 Scope of Use    Any use of the Service—browsing, registering, subscribing, posting Reviews or interacting in community features—constitutes acceptance of these Terms. Publisher may refuse or terminate access at its discretion.

4. Service Overview

4.1 Subscription Tiers
We currently offer one subscription plan: Digital Library Access. Pricing may change over time, and we reserve the right to adjust subscription fees. Subscribers will be notified in advance of any changes that affect their billing. This plan grants subscribers full online access to the entire catalogue, including all available titles from both Classical Gems and Hasalynx Pearls. Subscribers may also write and submit reviews where applicable.
A free trial is available to new subscribers. During this trial, you receive full access to all subscriber-only content without charge. If you do not cancel within the trial period, your subscription will be automatically activated and billed. Once access begins, your statutory right of withdrawal is waived in accordance with EU and Polish consumer law.

4.2 Content Changes   Publisher may add, modify or remove any Content at any time. Substantial reductions in available Content or benefits will be announced at least fourteen (14) days before taking effect.

5. Eligibility & Account Security
5.1 Age Requirement   Hasalynx Press does not publish adult material as its primary focus. However, some titles may contain mature themes or content intended for adult readers. Such content is presented with discretion and in accordance with applicable laws in Poland, including standards of taste and censorship. To access the Service, you must be at least eighteen (18) years old, or have verifiable parental or guardian consent. In such cases, a responsible adult must expressly agree to these Terms on your behalf. Hasalynx Press is not liable for any consequences arising from unsupervised access by minors. If a parent or guardian allows a child to use the website, they assume full responsibility for any exposure to age-appropriate or mature content. We do not offer refunds, compensation, or liability coverage in such cases. By using the Service, you agree to these terms.
5.2 Accurate Information    All registration details—including your name, email address, and payment information—must be true, accurate, and kept up to date. We reserve the right to suspend or terminate your account if we have reason to believe that any information provided is false, misleading, or unverifiable. In such cases, no refunds will be issued. By using the Service, you agree to these terms.
5.3 Account Responsibility    You are solely responsible for all activity conducted under your account credentials. If your account is misused, compromised, or involved in unauthorized activity, we reserve the right to suspend or terminate access. In such cases, no refunds will be issued for any remaining subscription period. By using the Service, you agree to these terms.

6. Subscriptions, Billing & Refunds
6.1 Renewal & Cancellation    Subscriptions auto-renew each billing cycle unless cancelled before renewal. Cancellation takes effect at the period’s end.
6.2 Payment Processing    All payments are handled by Wix Payments. We do not store full payment details. You authorize us to charge your payment method for fees and applicable taxes.
6.3 Refunds
This Refund Policy complies with EU and Polish consumer law, including the Consumer Rights Directive (2011/83/EU) and the Digital Content Directive (2019/770/EU). It is designed to support the sustainability of our publishing ecosystem while ensuring clarity, fairness, and legal transparency. Our subscription plan provides digital access to a curated literary archive for the duration of your active subscription. By subscribing, you enter into a digital access agreement rather than purchasing physical goods or acquiring permanent ownership. Please read these terms carefully before completing your purchase.
We offer a 7 day free trial that grants full access to subscriber only content. This trial allows you to explore the catalogue and determine whether our offerings meet your expectations. If you do not cancel within the 7 day period, your subscription will activate automatically and be considered purchased. At that moment, you will be charged, your access will continue uninterrupted, and your statutory right of withdrawal under EU and Polish law will be waived, as digital delivery has begun with your explicit consent. This structure aligns with Article 16(m) of Directive 2011/83/EU and Article 3(1) of Directive 2019/770/EU, which permit limiting withdrawal rights once digital content delivery has commenced.
All subscription purchases are final once post-trial access begins.
Eligible Refunds
A refund may be considered only if a promised feature—such as a specific book listed in the catalogue—is missing due to error, omission, or technical fault. In such cases:
· Contact us within 48 hours of activation
· We will respond within a few business days
· Resolution may include a technical fix, content delivery, or partial refund if the issue cannot be resolved.
No Refunds For
Refunds are not granted for:
· Change of mind, subscription regret, underuse, or forgotten trials
· Dissatisfaction with a book's content, genre, style, or literary quality
· Comparisons to free alternatives or public domain availability elsewhere
· Discovery or speculation about the Publisher's proprietary creative methods or production processes
· Translation quality, localization, or stylistic preferences
· Account misuse, breach of Terms, or sharing credentials outside your household
Catalogue Content
Our catalogue includes:
· Classical Gems: Public domain works selected for literary merit. Our editions may include enhancements created by Hasalynx Press.
· Hasalynx Pearls: Original works developed in-house and released under branded author identities using a range of creative methods.
Translated editions are supplementary. The English catalogue is the editorial basis of your subscription. Refunds are not issued for translation-related dissatisfaction unless a specific language version visibly listed in the catalogue is missing.
Access and Cancellation
Your subscription grants access to the digital catalogue only while active and paid. Access ends automatically upon cancellation or lapse. You may disable auto-renewal at any time in account settings. No partial refunds are issued for unused days or early cancellation. Content may not be downloaded, retained, or archived after cancellation.
Account Requirements
Registration information must be accurate and up to date. False or misleading information may result in account suspension without refund. Subscriptions are for household use only. Sharing credentials outside your household is prohibited and may result in suspension without refund.
Legal Acknowledgment
By completing your purchase, you confirm that you are purchasing digital content with immediate access and acknowledge that delivery of access fulfills our legal obligations. Under EU law for digital content, refund eligibility is void once access has been granted.

6.4 Chargebacks
Unauthorized chargebacks are strictly prohibited and result in immediate account suspension and permanent revocation of access. We reserve the right to dispute any chargeback, provide evidence of usage and fulfillment, and pursue legal action under applicable consumer fraud statutes. Any attempt to bypass refund boundaries, misuse access, or submit false claims is treated as abuse.

7. Intellectual Property & Use Restrictions
7.1 Ownership

Hasalynx Press and its affiliated imprints — Always Inspired Writing and Sunflower Romance Press — own all Hasalynx Pearls titles, all translations regardless of method or source, and all Classical Gems editions that include original enhancements such as formatting, annotations, stylistic changes, or translations. These works are protected by copyright and may not be copied, redistributed, or claimed by users. Hasalynx Press also owns all book covers and visual assets created for catalogue titles, including those produced using proprietary creative processes or licensed design platforms.

Public domain books published by Hasalynx Press that remain unmodified are used in accordance with public domain terms. To ensure global compliance, Hasalynx Press only publishes works whose authors and all contributors passed away before 1925, aligning with the 100-year standard recognized internationally. Unmodified public domain editions are not claimed as original content by Hasalynx Press.

All other original content — including website text, forms, translations, branding elements, layout, and software — is either owned by Hasalynx Press or by its service providers, partners, and third-party creators, and is used in accordance with applicable licensing terms. Certain visual assets displayed on the website, such as photographs, icons, and design elements, are sourced from third-party platforms including the Wix media library and Unsplash. These materials remain the intellectual property of their respective creators and are used by Hasalynx Press under the terms of the relevant licenses. No ownership or authorship is claimed by Hasalynx Press over such third-party content.

Users acquire no ownership rights in any content accessed through the Service. All rights not expressly granted are reserved by Hasalynx Press.

Reviews remain the intellectual property of their respective authors. By submitting a review, users grant Hasalynx Press a non-exclusive, royalty-free right to use submitted reviews and excerpts for editorial, promotional, and archival purposes.

7.2 Permitted Uses    Within your Subscription, you may:
•    Access and read content through the online catalogue.
•    Write and submit reviews, though publication is not guaranteed (please refer to the Review Guidelines for details).
•    Cite excerpts (up to 100 words) from catalogue titles for non-commercial, educational, academic, or personal use—with proper attribution. This includes quoting on personal blogs, websites, or social media.
•    Use book covers for non-commercial, educational, academic, or personal use—with proper attribution. This includes visual references on personal review blogs, websites, or social media.
7.3 Prohibited Conduct   Without Publisher’s written consent, you may not:
•    Reproduce, distribute, publicly display, or create derivative works beyond your subscription rights. Exception: Non-commercial fanfiction is permitted if it clearly states the original source and is not sold or monetized.
•    Use automated tools (including scraping, bots, or crawling) to extract, replicate, or index content.
•    Redistribute content via NFTs, blockchain platforms, torrents, file-sharing sites, or any unauthorized channels—including social media profiles, groups, or platforms.
•    Post full books or substantial excerpts on external websites, profiles, groups and platforms, even for academic or educational purposes.
•    Remove, alter, or obscure copyright notices or attribution metadata.
•    Demand unsolicited refunds or initiate chargebacks without prior contact and valid grounds. Such actions may result in legal action.
•    Share account credentials outside your household. Access may only be shared with individuals who live with you. If account misuse is detected and we determine that multiple unrelated individuals use the same account, access will be suspended and no refunds will be issued.
•    Share your account login data publicly, as this leads to misuse and multiple people accessing the account—it will be terminated.
•    Copy, reproduce, or claim ownership of any content or materials from the website. In the case of public domain books, you must source them elsewhere, as our editions may include original formatting, translations, annotations, or editorial changes that are protected by copyright.
•    Tamper with, reverse-engineer, or interfere with the website’s code or technical infrastructure.
•    Abuse the free trial system by using multiple payment methods or identities to bypass trial limits. All such accounts will be suspended and the user permanently banned.
•    Spam or misuse interactive features, including comment sections, forums, or review submissions. Accounts engaging in spam or disruptive behavior will be terminated.
•    Engage in other unethical or unlawful behavior on the platform.

8. User Reviews
Hasalynx Press accepts reviews only from active subscribers with verified accounts. Reviews must meet editorial standards and reflect genuine literary analysis—not casual impressions or star ratings. Minimum length is 300 words. Reviews must focus on characters, plot, themes, and literary structure, and maintain a respectful tone. Profanity, dismissive language, or vague commentary will result in rejection.
All reviews are submitted under a pseudonym and may be published at the Publisher’s discretion. Submission does not guarantee publication. Reviews may be removed at any time if they violate guidelines or no longer align with our publishing objectives. Misuse of the review form—including spam, abuse, or troll submissions—may result in account suspension without refund.
By submitting a review, you grant Hasalynx Press a license to use, reproduce, and share your review across its platforms. You may opt into our Reviewers List to receive future invitations and may be eligible for Top Reviewer recognition. All reviewers must continue to follow the Review Guidelines regardless of status.

9. Privacy & Data Protection
Our Privacy Policy (incorporated by reference) details how we collect, use and protect your data. Highlights:

9.4 Security & Retention   Data is stored on Wix’s secure servers with industry-standard encryption. We retain data only as long as needed for contractual, legal or business purposes, then delete or anonymize.
9.5 Cross-Border Transfers   Your data may be processed outside the EU under standard contractual clauses or other approved safeguards.

11. Termination & Suspension
11.1 Grounds   Publisher may suspend or terminate your access without notice for breach of these Terms, fraudulent activity, unauthorized chargebacks or other misuse.
11.2 Consequences   All rights granted under these Terms immediately cease. You must stop using the Service and delete downloaded Content unless otherwise permitted. No refunds except as provided in Section 6.
11.3 Survival   Sections 1 (Definitions), 7 (IP & Restrictions), 12 (Liability), 13 (Governing Law), 14 (Changes) and 15 (Contact) survive termination.

12. Disclaimers & Limitation of Liability
12.1 “As Is” Disclaimer   The Service is provided on an “as is” and “as available” basis. We disclaim all warranties, to the fullest extent allowed by law.
12.2 Exclusion of Damages   We are not liable for indirect, incidental, special, consequential or punitive damages, even if advised of their possibility.
12.3 Liability Cap
•    Consumers: Direct damages capped at twice the subscription fees you paid in the prior 12 months.
•    Business Users: Direct damages capped at subscription fees paid in the prior 12 months.
12.4 Force Majeure   We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, outages, strikes, government actions, war).

13. Governing Law & Dispute Resolution
13.1 Governing Law   These Terms and any dispute arising from them are governed by Polish law, without regard to conflict-of-law rules.
13.2 Jurisdiction & Venue   You submit to the exclusive jurisdiction of the courts located in Kielce, Poland, and waive any objections to venue.
13.3 Mediation & Arbitration   Before litigation, parties agree to good-faith mediation in Poland. If mediation fails, disputes may proceed to arbitration under Polish Arbitration Association rules, unless prohibited by law.

14. Changes to These Terms
14.1 Material Changes   We will notify Subscribers via email or on-site announcement at least fourteen (14) days before material changes take effect.
14.2 Non-Material Changes   Minor updates become effective upon posting.
14.3 Acceptance   Continued use of the Service after changes constitute acceptance. If you do not agree, you must stop using the Service.
